The constitutional revolution was like a bridge to the passage of Iranian society from the old world into a new and actually it evolved a revolution both in the political system, the government and in the Iranian society. In this period, with the decline of popular discourses such as the just monarchy in Shiite jurisprudence, we are witnessing the emergence of two new discourses and rivals in political jurisprudence under the constitutionalism and religious constitutional. It was in such a space that Mullah Abdul Rasul Madani Kashani, a constitutionalism scholar, was one of the libertarian clerics who spoke in a relatively precise way, beyond the framework of the traditional notion of liberty and close to the reality of the concept of democratic freedoms. His thesis (named Ensafieh), from the perspective of the history of the idea of modernism and liberation in Iran, is one of the serious writings in explaining the constitutionalism's compatibility with the foundations of Shari'a (islam religion), especially Shiite religion. By examining and pondering in the thesis, it can be seen that Kashani reads the rule of law in justifying constitutional rule, and also considers the origin of the rule of law in two subjects: the libertarian nature of man, the progress of the state and the prosperity.
